Contract Clauses Worth Considering
- Termite Inspection. If any termite damage is found, it is to be “made good” by vendor at vendors expense or purchaser has the right to make this offer null and void.
- Full building inspection. (Normally costs around $500). Not just structural. Satisfactory to the purchaser. Should any building matters arise then vendor is to make good at vendors expense or purchaser has the right to make this offer null and void.
- All electrical, gas and plumbing plant and equipment at the time of settlement are in good and working order, including any reticulation (pipe work, risers, sprinkler heads and timers).
- Finance clause should be which ever bank you are using within 14 or 21 days. Settlement should then be 21 days from finance approval.
- If you are not personally inspecting the property, then you may want to add a clause - subject to purchase's inspection and approval. Important in case you have any 'undesirables' living next door.
- If it is a strata title, then you may also want to include - subject to a copy of previous strata meetings to be provided to ensure that there are no major works about to be conducted or any disputes or ongoing matters. Should there be any, then the purchaser has the right to make this offer null and void.
